Marketplace & Storefronts: We provide hosted storefronts that enable vendors ("Sellers") to list and sell goods and services to customers ("Buyers").
Payments: We do not process payments. Transactions are securely handled by trusted third-party payment processors, including PayChangu and other gateways we may integrate.
Payouts: Sellers may withdraw available balances using payout functionality (API) made available by Payment Providers.
Delivery: Delivery is handled by third-party courier services registered with shop.mw. Delivery fees are calculated at checkout. Sellers are required to drop off packages with the courier using a provided drop code. Buyers, once notified, must present a unique redeem code to the courier to collect their parcel.
2) Fees
Processing Fee: A 10% processing fee applies to all transactions and is charged to both Buyers and Sellers.
Delivery Fees: Delivery charges are separate and displayed at checkout.
Gateway Fees: Additional fees charged by Payment Providers or couriers may apply.
3) User Accounts & Responsibilities
You must be at least 18 years old and provide accurate information.
You are responsible for safeguarding account credentials and all activity under your account.
Sellers must ensure listings are accurate, lawful, and compliant with applicable regulations (including taxes, product safety, import/export where applicable).
Buyers must review item descriptions, pricing, delivery terms, and Seller policies before purchasing.
4) Prohibited Items & Activities
You may not use the Platform for illegal or harmful purposes. Prohibited items include, without limitation: illegal drugs or paraphernalia; weapons or explosives; counterfeit or stolen goods; unsafe, recalled, or non‑compliant products; hate or extremist materials; and items that infringe third‑party intellectual property. shop.mw may remove listings or suspend accounts that violate this section.
5) Orders, Risk of Loss & Delivery
Contract for Sale: The sales contract is between Buyer and Seller; shop.mw is not a party.
Risk of Loss: Risk of loss transfers from Seller to Buyer when a parcel is accepted by a registered courier against a valid drop code. Couriers are independent contractors; their terms govern liability during transit.
Packaging & Compliance: Seller is responsible for adequate packaging and compliance with courier restrictions.
Collection: Buyer must present the correct redeem code (and ID where required) to receive the parcel.
6) Refunds, Returns & Disputes
Product Issues: Handled between Buyer and Seller under the Seller’s posted return/refund policy and applicable law.
Payment Disputes/Chargebacks: Managed by the relevant Payment Provider under its rules.
Delivery Issues: Claims for loss or damage in transit should be raised with the assigned courier. shop.mw may assist at its discretion to protect platform integrity.
Escalation: Where parties cannot resolve a dispute, shop.mw may review platform records and take appropriate account actions, but is not an adjudicator of product quality or courier performance.
7) Account Suspension, Holds & Termination
We may suspend or terminate accounts for policy violations, suspected fraud, chargeback abuse, or security risks.
We may place holds or reserves on Seller payouts (in coordination with Payment Providers) during investigations or to cover expected chargebacks/claims, consistent with applicable law and Payment Provider terms.
Upon termination, pending orders may be cancelled and access to dashboards may be restricted; required records may be retained as permitted by law.
8) Intellectual Property
Sellers grant shop.mw a non‑exclusive, worldwide, royalty‑free licence to host, display, and promote store content for the purpose of operating and marketing the Platform.
9) Warranty Disclaimer
The Platform is provided on an “as is” and “as available” basis without warranties of any kind. We disclaim all implied warranties to the fullest extent permitted by law.
10) Liability Limitations
To the maximum extent permitted by law, shop.mw, its affiliates, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or goodwill. In any event, our aggregate liability for claims relating to the Platform will not exceed the total fees you paid to shop.mw in the 3 months preceding the event giving rise to the claim.
11) Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after updates take effect constitutes acceptance of the revised Terms.
12) Governing Law & Dispute Resolution
These Terms are governed by the laws of Malawi. You agree to the exclusive jurisdiction of the competent courts in Blantyre, Malawi, to resolve any dispute arising out of or relating to these Terms or the Platform.
